There’s a reason I wouldn’t bike in Manhattan. Here, I’m in the street 90% of the time, the times I’m not in the street, I’m on a trail, or rolling up on a sidewalk to push a crossing button. The times I’m on a trail are generally when I’m with someone who’s not as comfortable road riding, and there the rules for pedestrians appear to be:
1. Make sure to have headphones in so that you can’t hear anyone coming.
2. If you’re walking a dog, make sure it’s poorly trained, and on a 10 yard leash
3. If you have a stroller, make sure it’s as wide as possible, and walk in the middle of the path. You’ve earned it.
4. When a cyclist passes you (after giving notice that you didn’t hear) make sure to jump and yell at them.
I had my headphones on last week, laying mulch by the walk up to the house, the mailman snuck right by me. Didn’t notice him till he was walking back to the truck.

Whats the critic score:viewer score ratio? If it’s close to 1:1 it’s usually fairly accurate. If there’s a disparity, you can figure out something aobut the film without even reading the reviews. High viewer low critic is a classic popcorn film. High critic low viewer is either artsy pretentious crap or highly politicized claptrap.
To its credit the 96% score is close to the audience score of 88%. When I see a disparity there it raises an eyebrow. Not that I look at these things too much. I suppose Metacritic is better?

Kinda related to the MSNBC thing: I had an interesting TDS observation last night that I wanted to pass on. I was at a work dinner in Europe with 4 colleagues. One other was American, who I think is pretty much a garden-variety leftish “moderate”. The other 3 are a Spaniard, a Canadian, and a Frenchman, all of whom have lived in the US for 10-20 years. Standard progs inside, but normal in a work context. Everybody at the table has an Engineering background with at least 20 years of experience in combined R&D/Eng/Mfg, and everybody gets along fine.
Somebody was talking about investment timing, and shifted to a comment about Trump still probably being in office 10 years from now, so wouldn’t that be horrible? Couple of us said something about “nah, 22nd Amendment, so Constitutionally impossible”, and pretty much simultaneously all the proggies jumped right to “yeah but there’s the Emoluments clause and that didn’t stop him”. Obviously wasn’t in the mood to debate their derangitude, so let the conversation go on by. Other fun parts of the conversation included how they’re sure they’ll get deported and have their kids sent to a camp in the desert if they get a traffic ticket, since that’s how Trump’s America is now.
Anyway, I had no idea the Emoluments thing was hot on anybody’s mind, but apparently it’s one of the go-to “what-abouts” that TDS sufferers have these days. Dunno whether it’s “foreign governments are booking at Trump hotels!!!!” or “he’s secretly getting paid by Rooskies” or what. Surprise to me.

Emoluments are essentially gifts. They don’t include fair market value payments for goods and services. Even if Trump is still an owner (and I’m not sure what his current status is), Russian and China could book every Trump property solid through the end of his second term and as long as they paid going rates, it wouldn’t fall under the Emoluments Clause.
If the current claims that a foreign government doing business with a company that a federal officer is a passive investor in (like a shareholder) violate the Emoluments Clause, then every federal officer is going to have divest from every publicly traded stock or private security, and arguably every publicly bond or private loan that involves a company that has a foreign government as a customer. Which would include any mutual fund with such securities.

No point in reading past ‘denying climate science’. It isn’t science. I would say that 99.9% of the people using those terms have no idea what science is.
Sure they do. Science is about ritualism and special texts that are only open to the select few running it, who lecture to the masses and tell them how to live their lives.

Climate science is a real thing. Skeptics aren’t “denying” science–a phrase which makes as much sense as saying that someone denies measurement or denies height–they’re skeptical that the conclusions being drawn by climate change hobbyists aren’t supported by accurately-measured data.
As I understand it, the “consensus” was really broad and was basically agreeing to the statement “the climate has changed and human activity has something to do with it”. No specification of how significant the human activity is; just that it may contribute in some degree. Now you have Lefties running around making bombastic, unsupported statements about the climate and screaming “consensus!!!” whenever they’re called on it.
It’s like if I argued that the entire population of America will be dead of diabetes-related illnesses if we don’t implement a total ban on sugar, then if anyone called me on it, started screeching “but there’s a consensus among dietitians that people should minimize their intake of refined sugar!!”
CAGW is built on a recursive motte-and-bailey argument. The mottes are things that are hard to dispute, like climate changing and humans playing at least some role in it. The baileys are humans being the sole cause, human-emitted CO2 being the primary driver, all surface ice melting, the seas rising tremendously, etc.

To be perfectly honest, I’m not yet convinced that recent changes in climate are in any way outside normal bounds.
Once we get out of this ice age, we’ll be able to figure out what Normal is.

And I’m not a scientist, much less a climatologist, but I’m as well-equipped as anyone to determine the logical validity of an argument, and I’m not seeing it yet.
Indeed, the only thing we have the benefit of in the present day is better measurements*. It is hard to compare to the distant past when no one was keeping records then. It is pretty well established that there were times in the planet’s history when life was abundant and there were no ice caps. So, whatever is going to happen, it may not be unprecedented.

The other big problem of “climate change”, besides the motte-and-bailey arguments, is the widespread malfeasance and manipulation of data. Back in the day, a lot of science was locked up as proprietary. Now, they hide the data but don’t have the excuse.

The satellite record shows a consistent gradual rise in global average temperature on the order of 0.012 degrees Celsius per decade, and the mechanism for this rise, if accurately measured, is not well understood (the extension of the greenhouse effect to the atmosphere at large being only part of the picture).
Correction: the rate of change is 0.12 degrees Celsius per decade.

I suppose it depends on who you ask. NOAA, CRU, etc. are all insistent it’s already happened. They have to continually “adjust” the data to make it happen, but while the point in the past where it happens moves slightly, it is still in the past according to their cooked books.
I have yet to see evidence that humans are playing any part in climate change. In fact, the models that best reflect the data show the purported drivers by which we might have no impact.

This is an unfortunate (for vegans) consequence of evolution but we’re more likely to genetically engineer the human body to produce the missing nutrients (like other animals can) than we are to find non-animal sources of them. However, we’d probably have to give up brain power to do it; the human body is optimized for feeding the brain rather than digesting plants per se.
This is all great news for the planet, yet no one thanks vegans for creating a market for these alternatives.

My question about primaries has always been: why does the state pay for them? Parties are private concoctions, and who they send to the general and how they are selected is of no concern of mine, and I sure as hell don’t want to pay taxes so that the state can create forms and decide who qualified and, worst of all, who cannot be on the ballot. Caucus, smokey backroom, or 10-man cage fight, I don’t care how the guy is picked so long as I’m not taxed to underwrite the process.

The state runs them so the parties can’t be sued for discrimination. The state is allowed to discriminate, but only in certain ways (e.g. open vs closed primary). Of course, the fact that no party is actually required to run a primary election at all just creates a nice legal paradox that can be conveniently ignored.

MSNBC’s Lawrence O’Donnell is quickly walking back his essentially unsourced claim that “Russian oligarchs cosigned Trump loans”.
We’ve gone from “That’s the way it is” (which wasn’t totally true anyway) to that’s the way it is in someone’s fevered imagination.
I heard his walkback was that they could not prove the story, which didn’t mean it still wasn’t true.. Sort of like the current stance that while Mueller found no collusion or obstruction crimes to charge Trump with, he still was not exoneration, because the new standard was “guilty till proven otherwise” for enemies of the democrat party.
I think the loan docs are public record and they have been examined. There are no Rooshins involved. The whole Russian narrative is a fiction.
This is the part that (almost) no one in the Media is covering: Trump’s lawyer’s C&D letter explicitly claims that the NY Times v. Sullivan standard is met (“with reckless disregard for the truth or falsity”) because THE LOAN DOCS CAN BE FOUND VIA PUBLIC RECORD SEARCH.
“Numerous documents for each of these loans are also recorded, publicly available, and searchable online. Thus, actual malice can easily be proven based on your reckless disregard of the truth and unreasonable reliance on an alleged ‘source’ who you will not even identify in your story and likely is seeking to mislead you and the public for political reasons or other ulterior motives.”
THAT, and that alone, is why O’Donnell had to walk it back. It isn’t just that “it couldn’t be verified” because if that were the case, the NBC lawyers would have told Trump’s lawyer to stick it up his ass or “sue us” and leaned on the extraordinarily high burden of proving libel under NY Times v. Sullivan. The fact that O’Donnell retracted in 24 hours is all you need to know. MSNBC’s lawyers did a public search and were like, “OH FUCK!”

Their other option would have been to argue the truth of their claim, by showing that it related to non-public loan documents per their source. Of course, that would have meant burning their source. I wouldn’t be surprised if they went to O’Donnell and said “If you can’t produce these documents, and the source to verify them, we got nothing.” And he couldn’t, so here we are – a mealy-ass nonapology, a narrative launched, and O’Donnell suffering precisely zero consequences.
The Iron Law applies – The DemOp Media was rewarded, and nobody was punished, so the spew of false accusations will continue unabated.

I took a quick look at O’Donnell’s twitter feed after he said he would walk it back and it is AMAZING how fucking stupid those people are. A large percentage of them were absolutely certain that it was TRUE, even after O’Donnell had just said he shouldn’t have said it.
What are the odds that this resurfaces again – and again – during the run-up to the election. It will be just little snippets here and there in the left fringe about how electing Trump is a “vote for Putin.” Watch. There’s my prediction.
This incident reminds me of a courtroom drama, where the lawyer asks an outrageous question, is called out of order, and then withdraws the question. But it’s still “out there” in the jurors’ minds.

I find it fascinating that (generalization alert) adult fathers and sons tend to have better relationships, and not by a little, than adult mothers and daughters.
Men don’t fight over status. Or, I should say, we do, but it’s stable. Both parties know that the Dad is in charge when the boy is born. Then, at some point ~14 to ~20 years later, the boy beat the Dad at basketball, or takes the garden rake out of Dad’s hand an tells him to go take a break, or whatever. Dad knows at that point his fangs are getting dull and his eyes are getting worse, and he turns over hill for his son. (or at least so I have observed from other boys with, you know, father’s who aren’t pieces of shit) The transitions are dramatic (see Hamlet, eg) but stable once they happen.
Women jockey for position ALL THE TIME because the things that control social hierarchy for women fluctuate from week to week, making their position in the hierarchy a Red Queen’s Race. Its very weird to me to see my wife resent the attention that I give my daughter, and the way that my daughter responds in healthy ways to my attention and with social aggression (that my wife doesn’t understand) to attention from her.
Along these lines, men seem to have conclusive engagements over status (and other issues), with the loser more or less accepting the loss. Women prefer drawn-out low-level grinding conflicts that don’t pose the risk of a conclusive engagement.

To be fair, being able to demand unconditional surrender requires that the other side, and its proxy backers, do not have nukes.
Of course men do. This is pretty standard for lots of species. Males are more likely to actually be capable of quickly injuring or killing each other, so they avoid MAD by having “the line” that doesn’t get crossed and by seeing victory or defeat as being conclusive. If not for those two things, males would be much more likely to kill each other or maim each other enough that they are vulnerable to a third party. (In addition, mammals have a very hard time killing or crossing “the line” with each other if they make eye contact… which is why groups in conflict dehumanize each other other. It lets their own side overcome that instinctive hurdle).
For humans in the wild, men are the first line of defense for the group when a threat’s possible. But 99% of the potential threats that get to their line don’t really turn hot, so they have to be able to back off of the fight. The women are the second and last line (around the children). If a threat gets to their line, the 1st line has already fallen, so 100% of their contacts with threats are fights to the death.
This pretty much explains all of the male/female differences in conflict behaviour.

My work habits are actually very feminine in this way. I grew up near starvation and objective poverty (the bad parts of Appalachia are about the only part of the US where a person with no mental problems can still starve to death, when I lived there). Compared to what I knew then, I’m fabulously wealthy and don’t work nearly as hard or long as my peers.
This is true. I think a lot of the alleged gender pay gap is a result of women taking the job they like rather than the job that pays since they have a high-earning husband and can afford to do so. If a woman doesn’t actually need a job to stay above water, she’ll probably take one that is enjoyable with low pay over one that is stressful with high pay.
A lot of people – including a lot of women – still consider it the man’s job to earn most of the income.
My wife left the professional world to stay home with the kids. When she returned to work, it was for the school so her schedule matched theirs. She could have made a lot more going back to finance, but this worked better for our family.
Ours, I think, is a very common story.

The Justice Department watchdog on Thursday released a scathing report stating that former FBI Director James Comey violated bureau policies and his employment agreement with his handling of official memos detailing his interactions with President Trump, one of which contained classified information.
“We conclude that Comey’s retention, handling, and dissemination of certain Memos violated Department and FBI policies, and his FBI Employment Agreement,” the Justice Department inspector general report states, noting that “much of the content of the Memos was directly tied to FBI investigative activities.”
While Justice Department Inspector General Michael Horowitz declined to make a recommendation as to whether to charge the former FBI chief, he said Comey broke FBI policies by seeking to share unauthorized information about ongoing investigations with a friend who then gave it to The New York Times two months after his removal.
He also refuted Comey’s claims that his memos were not FBI records but personal recollections, stating that the director was operating in an official capacity and that he acknowledged in his FBI Employment Agreement that “[a]ll information acquired by [Comey] in connection with [his] official duties with the FBI…remain[s] the property of the United States of America.”
“Former Director Comey failed to live up to this responsibility,” the 83-page report says. “By not safeguarding sensitive information obtained during the course of his FBI employment, and by using it to create public pressure for official action, Comey set a dangerous example for the over 35,000 current FBI employees—and the many thousands more former FBI employees—who similarly have access to or knowledge of non-public information.”
And nothing else happened.
Horowitz is still a Deep Stater. Comey committed crimes, yet he makes no recommendation for prosecution but only discusses “policy” and “agreements”. He’s doing a modified limited hangout to protect Comey and, I expect will do so to protect other FBI Deep Staters. I’m sure he rationalizes his role in covering up a criminal conspiracy as “protecting the institution”, which is too important to sacrifice to merely prosecuting criminals employed by the institution.
I think we are learning that the administrative state has slipped its leash, and is accountable to no one. Not Congress, and (now) not the President.
They are still accountable Congress. But Congress does not want to act.
Only at a very high level – funding and agency scope. At any level other than that, they are technically executive agencies not answerable to Congress. And they have proven it over years of refusing Congressional subpoenas, refusing to provide information to Congress, and generally treating Congressional oversight with a kind of amused contempt.
Congress regularly cuts their funding. It’s called a ” government shutdown”. But then Congress grants them “back pay” (how is it “back pay” when you did no “back work”, certain “essential” personnel notwithstanding?).
You are right that it is a very high level oversight, generally. But that is exactly the level that could bring them to heel. Congress could disestablish entire agencies, or slash their workforces, or remove all discretion in the law, and a host of other things that could radically transform the bureaucracy. But they won’t.
At this point, I don’t think its crazy to think that the administrative state, or at least its Praetorian Guard in the law enforcement and intelligence agencies, have the whip hand over Congress due to evidence of embarrassing or criminal activity by a number of Congress members that they deploy behind closed doors as necessary to keep Congress in line.
That may be true, but at the same time Congress could do a lot of things to undermine that. They won’t, of course, because they love their own power more than anything else. The structure and rules of Congress are entirely up to Congress (see: gutting the filibuster). Committee memberships, employment benefits, the privileges of office, the number of members of the House, etc. can all be changed (but, again, they won’t be) to reduce the value of such “leverage”.
I don’t think ‘protecting the institution means what he thinks it means. They are sowing the seeds of their own destruction.
