Going by results, it seems my weirdness wasn’t exactly a crowd-pleaser. Either that, or, all the autumnal types were busy getting their Fall on. Or, could it be that Friday nights are the answer? Here’s something to set the mood for the night. (What?? I’m a guy of many facets…)

Sir Digby topic: I am considering getting certified as a Gemologist through the GIA. I’m not looking for a new career, exactly. This is an area that I like (gemstones), and something that, while pricey, could probably be accomplished fairly quickly, and give me other job options, should I want/need them. I don’t exactly relish the idea of standing around in a suit all day, just to sell some high-priced baubles. But, that isn’t the only type of gemologist work, either. Do any of you have experience with later-in-life career changes? How about delayed education or career training? (Anyone have any jeweler-type contacts you could share?) I’d like input on this, especially for issues I may not be considering.
Combining two things with which I am somewhat familiar: Crime, and, humor.
I hate to say it, but, I don’t think we’ve heard the last in the Botham Jean murder case. Between the Judge/Bible brouhaha, the subsequent murder of one of the witnesses, and, the appeal that I would think is forthcoming, it seems like this may stay in the media longer than the Las Vegas massacre. I haven’t seen anything in-depth about the investigation yet. However, I find it odd that the DA was able to effectively “prove” intent, while using arguments that seems to show recklessness, effectively making it manslaughter. Don’t take this to mean that I think the officer isn’t culpable for his homicide—she should be doing time. Maybe the 10 years—which will likely be somewhere around three or four year, barring any troubles inside—is a type of compromise? What do you think?

One of my close family members is a “credentialed” gemologist through GIA. I don’t think that they would recommend it at this point. Limited job options to make any kind of real money.
What do they do for work?
They went through the regular stuff. After receiving a BFA in jewelry design and metalwork, went on to get the gemologist cert, worked as a designer and jeweler, went on to the Diamond Exchange and then a bead company. Not many complimentary things to say about the high end world, which is the only way to make real money, and then, it’s mostly who you know (like most everything, it seems). There is freelance work as an insurance appraiser, though.
They left the field about 5 years ago. Completely fed up.

I am not comfortable with Guyger being found guilty of the murder of Jean. In my (likely wrong) thinking, murder must show willful intent. It’s not like she decided on the way home to shoot her upstairs neighbor. Manslaughter; absolutely. Murder; I don’t see it.

If I intend to kill you because I sincerely, even correctly, believe that my killing you will cause unicorns with rainbow farts to arise and fuel green reactors, I have committed murder, because I intended to kill you and fueling reactors with clean unicorn farts is not a legal justification for murder. Justification is an on off switch. If an act is justified you are free to go. If it is not, no matter what you believed to be the case, you are on the hook for the crime your actions constituted. She was trespassing, so she had no reason to be there. She could have left. But she feared for her life, so instead of ordering him to freeze or hands up, she just blasted him away. If she was a non-police non-woman, we wouldn’t be even discussing this.
I felt 10 years was about right, though. I’m not a legal expert admittedly. There’s political anger though also because the victim is black.
I probably know too much about this because I’m local to the story, and the media was just nonstop on this.
The “witness” that was killed was not a key witness. He was one of the neighbors who testified that she didn’t say anything to him before blasting. A bunch of others aid the same. And someone had tried to kill that dude the year before and shot him. He was a drug dealer and possible gang affiliation. I’m not really sold that this is a retaliation put on by Dallas police or anything.

This part continues to bother me. She was the trespasser, even if inadvertent. As the lawful resident, if he used the threat of force or even used force, to defend himself and his property, it would be justifiable. To use that lawful use or threat of use as a justification for escalated behavior by the trespasser is BS. Or would be if she didn’t have a badge.

Intent is a lower bar than premeditation. 1st degree murder requires premeditation. ie that you planned to kill. some degree of prior (need not be long prior) planning. other degrees of murder simply require intent or in some cases depraved indifference/reckless disregard. ie that you meant to kill the person at the moment you shot, or you did something like blazing away at a house which any sane person would know was likely to kill someone. Manslaughter is two things, either killing someone accidentally, but by a course of action that was sufficiently negligent that you can be held culpable for the death, or in a blind passion, caught your best friend in bed with your wife and instantly shot them, or beat someone to death in a fight where you had no intent of killing them. I hear people saying this case should be manslaughter but I do not see it. She shot and killed him, that is deliberate at least, and could be premeditated. Self defense is a justification for a killing, but this was manifestly not self defense. Even taking her claims at face value she deliberately killed him, she did not kill him by mistake (which would be manslaughter) her ‘mistake’ was about whether or not she was justified in killing him, and to me once the justification fails, because he was NOT in her apartment, she becomes legally responsible for her actual action, which was to deliberately kill him, ie. murder.
Even if it were her apartment, I think a good case could be made that if she felt afraid for her life, she didn’t properly exercise a duty to retreat.
That for me is absolutely the clincher.

Nope, self defense has an objective component because the other person also has a right to their life. You don’t get to be wrong about the threat unless the mistake was because the other person did something that reasonably caused you to believe they were a threat. Her error in entering his apartment does not excuse her mistake that he was a threat. He did not cause the mistake, she did. If I pull a toy gun on you in an alley and you shoot me, I caused the mistake and you can claim self defense and win. If I eat ice cream in my house and you break in by mistake you cannot.
You’re still arguing from a legal perspective though. And I believe the “was it reasonable” to be believe her life was in danger argument was brought up by our own R C Dean in the original discussion of this. And is a good one.

Reality is objective, not subjective. Lots of sick people do sick things and think they are in the right. Without clear objective bounds, laws are useless. Hence why the whole cop line of ‘feared for my life’ is so repulsive.

From my cursory reading about the case and some courtroom transcripts, I believe that this was due to the incompetence of the defense lawyers. At one point during the cross-examination, the prosecution basically stated the legal definition of murder and asked Guyger if she did that, and she answered “yes”. I wonder what sort of preparation her lawyers gave her before cross-examination.
I hadn’t heard about that (didn’t do any real research). I am kind of shocked that a big-city cop, in Texas, had such ineffectual counsel. Most Texas union-type orgs for police are understood to have pretty competent attorneys.
Also, they just want on and on about the affair she was having which had jack shit to do with the case.
I mean part of the game is making the jury hate the person, and they were given a long leash to do that. I only know legal stuff from television so I’m thinking to myself couldn’t the defense argue all this shit was irrelevant? Maybe not. Not sure how it works in real life.

If she was on duty and did this then she is in “reasonable fear for her life.” Ergo, it’s a good shoot and our hero in blue made it home safely. That night she was off duty and there was no way to paint the victim as the aggressor. That preprogrammed response now proves second degree murder.
Also, her failure to render first aid and the texts (or calls, I forget which) she made immediately after shooting him shows she was trying to cover her ass.

Comodious Spitoon may be gone to bed, but just in case, I’ll mention I was really disappointed in Return of the King, which continued the Jackson tradition of fucking things up to make everything pettier, stupider, blander and less epic that The Two Towers started, but did it to meaningful, important characters.
Eowyn/Faramir romance is a 60 second scene in extended edition. Reading it made my heart melt and I was 11 at the time. Do you know how hard it is to get a 11 year old boy to not yell “enough shmoop, get back to sword fighting”?
Faramir/Denethor relation of a stern father and younger son who never measured up, now disconnected because the Boromir, whom they both loved, is dead on a mission that should have been Faramir’s by right. Initially all I could think was “Denethor is a dick” but then Faramir is brought back and only then I understand “oh god, he loves his son as much as his son loves him, but they don’t know how to tell each other that.” Hey, I was 11.
On that topic, when Faramir is ordered to retake Osgiliath, he doesn’t just lead cream of his army in a pointless charge.
Entire character of Denethor. In the movie, he’s a pompous fool who becomes a raving lunatic so whole theatre can cheer when Gandalf hits him with the stick. In the book, he’s a seemingly wise and far-sighter strategist who understands the situation and does best with limited resources, so by the time he gets revealed as completely bonkers, it’s a shocking, staggering scene of conflicting emotion.
Charge of the Rohirrim. Theoden’s goal in life is not to depopulate Rohan. He doesn’t stop and sportingly give a chance to his enemies to set up a proper pike wall to maximize losses of his cavalry. It should have been a bold, exciting scene of chaos and confusion as Orc General’s confidence crumbles when he realizes he was outplayed, his rearguard was bypassed and now angry heavy cavalry is savaging his rear ranks.
Sam and Frodo in Mordor should have been a goddamn horror film. He’s a horror director, how did he fuck that up?
And then you get a generation that bases its impression of Lord of the Rings on the movies and thinks books are simple, with no female characters, starkly good/evil characters, no drama, conflict or character development.

The Breen were originally an inside joke IIRC, named after a producer’s kid or something. They were mentioned several times during TNG but weren’t seen until DS9.
My favorite badass was the female shapeshifter. Holy crap was she terrifying.

I liked the original show as a kid, and the first few movies I even liked the next generation briefly, but then they went more and more down the BS post scarcity economy, that somehow still had a hyper authoritarian hierarchical structure. And despite the clip, the Ferengi are portrayed with less nuance and decency than Shylock most of the time that I have seen.

I chalk it up to the galaxy of different writers they used.
There was a noticeable shift in how the Ferengi were portrayed during the Dominion War story arc. That had a lot to do with Ira Steven Behr finally given the ability to write them in a three-dimensional way. We eventually see that most of what we’ve seen of the Ferengi and the Cardassians were through the eyes of the Federation, and the Federation (as represented by Sisko) is as bigoted as hell.
I had stopped watching by then, so I’ll take your word for it.
I was told by a reliable source (mostly sober John Titor on the Discord) that end of DS9 left Ferengi as a woman-ruled, no longer plutocratic society in which accumulation of profit was no longer the driving force.

You are harder on the movies than I am. I thought Jackson did a generally good job, but I see all the flaws you listed and agree with most of them. The only one where I think Jackson made the right choice (although some others I forgive because the movie was already at 3 films and 9 plus hours) was the Charge of Rohan. Forming the line before the charge is visually powerful, where a more immediate, irregular cavalry charge may have been tactically better it isn’t as visually impressive.

Most complaints I have boil down to that his characters end up stupider, simpler, shittier and less deep then they are in the books, for no reason I can conceive. It’s just character writing, not crazy special effects, or shit that requires 20 minutes of exposition.

In lower Manhattan I would go to a dive bar called “The Patriot”. Inexpensive beer, a nice dive feel, elk, deer and javalina mounts and once you they got to know you very welcoming. Plus it had an inexpensive jukebox with classic country & western hooked up to a great sound system.

In Hawaii the first place I take visitors is “La Marianna’s”. It is the last of the old style tiki bars. Food is meh, but drinking a tropical drink and watching the sailboats is a fitting welcome.

i go to KC every June (AP exam reading), and we usually stay in the Westin at Crown Center. One or two Jack Stack trips are obligatory, especially since it’s an easy walk.

I get the Kurds were our allies. I never felt threatened any time I was north of the “green line” in Kurdistan. In fact in 2008 we were not permitted to carry weapons off the airfield up there.

I know for a fact in 2003, 2004 and 2008 that the US was permitting the Turks to invade northern Iraq with brigade size elements up to a certain line to kill the communist Kurd groups. I listened to the updates on the daily reports. What I don’t know if this was more of the same, but in Syria, because I have “lost the bubble” on which groups are where.
I am fully for honoring out commitments to those interpreters, and soldiers that we promised visas to. (Iraqi, Kurd and Afghani) That motherfucker Obama sat on their visa applications for eight years. Trump started them moving again, but there not as many to process- they are dead. So the US is doing to the Kurds what we did to the Montagnards, the Hmung, and others. Supporting the US is often not a good deal for smaller groups. It is a raw deal. SD I’m not sure this qualifies a later in life career change but here goes. I spent 4 years in the real world before returning to law school. I worked a number of low paid jobs. From them Iearned what I did and did not want in a job. Went I went back to school I was very focused and worked like a dog because I knew what I truly wanted.
I don’t think the GIA certification will get you anywhere unless you work in the jewelry industry or, maybe, in insurance. I’m not sure how long you’ve been in your job but I would guess you have a pension coming after 20 years. Given your hours, wouldn’t it make more sense to consider what you want as a next career and go to school to train for that?
Well, that’s the rub–I have very little in the way of college (about the amount of an Associate’s), and going on 20 years in LE in a non-sworn position, with about another 7 or so to go. I don’t want to continue in LE after my time in, and, I’m not exactly in a position to go back for a degree, especially after a 20 year absence, and this is considering that I work FOR a college, who, by the way, has a rather stingy policy for “degree assistance”.
I like gems, and can see picking up the curriculum easily enough, and in a fairly short time. It’s what I would do with it that is the biggest question at the moment.
Personally, I think my aptitude has been Law, but, getting a JD is pretty much in my rear-view mirror.

Pffftt. I’ve taken a number of online courses over the years. Lots of returning/never attended older adults.
Figure out what you want to do and if a degree is needed for that (job/personal enrichment/lark), just grind it out. Lots and lots of options open now in the online space or hybrid, many from reputable institutions. Assuming your AS mostly/fully transfer for credit, taking one or two classes per term will net you a degree by the time you retire.
I don’t have an Associate’s–just 62 hours or so of non-core classes. So, I’d be grinding classes that I’ve had virtually no connection to in decades. I can’t seem to psyche myself up for that, hence my leaning towards something that’s certification-based.
The other issue is the “figure out what you want to do”, as I don’t actually know of anything. I never had hobbies growing up, per se, and wasn’t taught anything remotely close to an employable skill.
Take the Kolbe A profile like Chafed says, you need some direction. I traded a job I thought I wanted (investments) for a hobby I liked (auto mechanic). I still trade stocks, now without having to ask for permission, but I’m self employed and work on cars all day. I really like my work and life, and my investments have helped pave the way so I don’t worry what happens down the road.
I did. Will have to go over it in detail and maybe do their job-based…whatever you call it.

Digby, My advice on the GIA thing is unless you are doing it because you are really interested in the subject matter, don’t. If you are looking to add employability by learning skills, learn something in the trades. The skills are more portable, more widely useful, generally less expensive to learn, and in a great many cases better paid than the standard educational path. Don’t spend 10s of thousands training yourself to a career you pick just for the money. You find yourself in your 50s with a mediocre income and a career you don’t particularly enjoy and a very uphill climb to change to anything else.

The Trade Winds returned today which is always nice. Anybody need apple bananas? I harvested another bunch today so I need to deal with 80-100 bananas in the next 72 hours. I’ll bring some sailing tomorrow for my crewmates, but not on the boat since they are considered bad luck.

When I was about 8, I decided to test the theory about whether or not you would really slip on a banana peel. I did this by eating a banana and putting the peel on the carpeted living room floor, then sprinting across it at full speed. I didn’t really slip and fall so much as leave a big brown stain of smashed banana mush on the carpet. When my mom came home and asked what the fuck that was, I blamed it on the dog.

My little not-brother has broken up with his second baby mama and is living with his sister until her man gets out of jail, but can’t live there once he gets out because a court order means they need to stay away from each other, and he can’t stay with his mom because I guess he doesn’t get along with her man; so of course stupidly I offered him a place to stay. It’s sad how someone raised beside you can get caught up in all this bullshit, and no matter what you do, you can’t save them.
